EXECUTIVE ORDER OF GARLAND COUNTY JUDGE FOR BURN BAN
WHEREAS, it has been determined by the Garland County Judge at this
time certain hazards and dangerous conditions exist brought about by open
burning, and further that said burning constitutes a serious hazard to the health,
safety, and welfare of persons and property located within the unincorporated areas of Garland County; and,
WHEREAS, it is necessary and proper that a burn ban be declared, due to
certain hazards and dangerous conditions, beginning 6:00 p.m this 21st day of
October 2022, and ending upon authorization from this office. Pursuant to
Amendment 55 of the Arkansas Constitution and other relevant statutory authority, a burn ban is hereby issued for all unincorporated areas of Garland County.
PROHIBITED CONDUCT
It shall be unlawful for any person to burn or cause to be burned any leaves,
trash, forest vegetation, or combustible material of any kind or to permit any such
fire or burning within the unincorporated areas of the county during a burn ban,
without a permit.
It shall be unlawful for any person to kindle or maintain any bonfire or
rubbish fire or authorize such a fire to be kindled or maintained during a burn ban
without a permit. It shall be unlawful for any person during construction, repair,
or demolition of buildings or structures to burn waste materials or rubbish during
a burn ban without a permit.
It shall be unlawful to cause smoke to obstruct roadways within Garland
County during open burning of combustible materials. It shall be unlawful to burn
timber, croplands, rangelands, grasslands, pastures, or stubble lands along
roadways within Garland County during a burn ban without a permit. It shall be
unlawful for any person to use fireworks during a burn ban without a permit.
It shall be unlawful for any person to burn leaves, trash, garbage, yard
waste, construction debris, or any combustible materials in any container, which
includes those commonly referred to as burn barrels, during a burn ban without a
permit. Burning in containers constitutes open burning.
Nothing in this executive order shall be construed as impairing or interfering with the authority of the Garland County Sheriff's Office or other law enforcement agencies from issuing citations under the Arkansas Criminal Code for conduct where there is reasonable cause to believe that a criminal offense has been
committed. Violations of the burn ban itself may also be enforced by these
agencies and violators are subject to fines for each violation.
